now at 11:00, chasing down suspects in retail heists on the peninsula. the bust that put dozens of people in cuffs. plus, next time you go to a restaurant, surcharges could be cut out but you may be paying more in the end. xfrjs things get hot over a bay area recall effort. >> i don't care about the money, i care about the justice. plus, they are one of the biggest attractions at fisherman's wharf. right now is the best time to see and hear them. what's causing a sea lion invasion. from kpix this is the late news with sara donchey on cbs news bay area. >> good evening, i'm juliette goodrich in for sara tonight. you know, when you go out to eat, tipping can be a very touchy subject, and we've seen some san francisco restaurants do away with tipping entirely,

replacing them with service charges, automatically tacked on to your bill. and then there's still a lot of debate over whether or not that's even fair. well, those extra charges that are as high as 20% of your bill are about to be illegal. yes, i said illegal. but our lauren toms reports some industry experts say this might not translate to cheaper dining bills and, in fact, could be bad for both customers and restaurants. >> reporter: diners in san francisco often think twice when they see a common line at the bottom of their menu warning of a mandatory service charge. and under a new law, that may be going away. but food experts like this one who writes table hopper says this isn't great news for customers or the restaurants. >> just when you thought your pork chop was already really expensive, guess what, we are going to be seeing even higher

prices. because there's nowhere else, you know, restaurants can put these fees and cover wages, especially higher hourly wages now that they've had to offer in order to retain employees. >> reporter: a law taking effect in july would ban junk fees commonly seen in ticket sale, but on tuesday, the state attorney general reportedly confirmed that also applies to restaurant fees. >> it's used to create an equitable model for employees. so typically servers at restaurants make much more money than folks working back of house and your dishwasher. so what it does is it creates a way for those funds to be distributed equitably. >> reporter: tom has been leading food tours in san francisco for decades. he's seen the restaurant price roller coaster and says the change may not be all bad news, shifting attention back to mom and pop restaurants. >> the restaurants you go into you feel like you're part of

that restaurant, at that point, it's kind of secondary. so i think as long as restaurants maintain that, knowing their customers, and really being that neighborhood restaurant, i think they're going to do okay. >> reporter: some fear the change could make restaurants less equitable for staff. golden gate restaurant association director laurie thomas says restaurants will be in a bind for how to keep up their wages while also keeping customers coming. >> so now do you take their rate down and go to an old fashioned tip model and say you've got to tip out the whole house, but that drops everybody's salaries, because you're going back to another model. or do you raise your prices 20%, 25%. >> reporter: for her, she says while customers may feel some relief by not seeing the added charges, they'll still feel it in their wallet. >> if you were to look into your magic ball, how would you see restaurants in this city adapting to this new structure?

>> i see prices raising, you know, easily 5%, 15%. it's going to be tricky. but not all is lost. it could end up -- things could change. >> according to the bill, food delivery services like doordash and grubhub are exempt from the law. across the country, dozens of protesters were arrested at columbia university in new york city after riot police brought in a s.w.a.t. vehicle to then just retake an occupy building. the nypd pulled out a ladder from that armored vehicle right there and at least 50 officers carrying zip ties and riot shields actually climbed through the second story window one by one. protesters had seized and barricaded that columbia administration building the day before. the campus protests we're seeing nationwide started at columbia in response to the israeli/gaza conflict. they've been calling for universities to divest from

companies that do business with israel. and then just a few blocks away demonstrators lit off flares in a stand-off with police just outside the main gate of city college of new york. tonight riot police cleared their encampment that first formed last week. and at the university of south florida, police used tear gas on pro-palestinian protesters while breaking up their encampment. protesters started setting up this morning and riot police warned if they didn't leave, they would use tear gas and rubber bullets. back here in the bay area, police on the peninsula, they released this video, it's of officers actually chasing down a retail theft suspect. thieves were snatching goods from a san mateo target store. so san mateo, daly city, and san bruno officer, they teamed up to crack down on retail theft during a seven-month ration. they arrested 88 people and recovered over 700 stolen items. so it's no secret that

california's legal cannabis market has been floundering. legal sales are shrinking while the black market is thriving. but this could be a game changer. the dea is expected to make the most significant change in u.s. drug policy in more than 50 years. the agency is expected to reclassify marijuana as a lower risk substance. right now cannabis is classified as a schedule one drug, in the same category as heroin and fentanyl. but the federal proposal would change cannabis to a schedule three substance, like ketamine and steroids. so drugs inthis category are considered less dangerous and less addictive. it also means the consequences for using them are less severe. well tonight we did talk to a former federal prosecutor who now represents the cannabis industry. he told us it could allow dispensaries to deduct business expenses on their federal tax returns, easing their tax burden.

>> if it's reclassified to a schedule three, we will be treated like every other business, as we should have been all along. this is, i hope, just the beginning. i hope that the state sees that by reducing its taxes that'll allow the industry to become more competitive with the illicit market and hopefully put it out of business. >> so the dea still needs to jump through some hoops to reclassify marijuana and that process could take months. it is official, alameda county voters will decide whether to recall d.a. pamela price. the recall vote got the green light from the board of supervisors today. and as our katie nielsen reports, things got pretty heated today when both sides of the recall effort faced off outside of that meeting. >> ain't no power like the power of the power, because the power of the people don't stop. >> recall price, recall price, recall price. >> reporter: it was a war of

words in the plaza outside the alameda county administration building. supporters of current district attorney pamela price attempting to drown out a rally by those wanting to remove her from office. >> you guys have had your chance, this is our press conference. this is for the victims, the victims are here. we stand for the victims. >> the people are here. the people are here. the people are here. the people are here. >> that shows you right there -- >> we are the people. >> and so are we. we are the people as well. >> reporter: current alameda county district attorney pamela price called on the board of supervisors to block a recall election that could possibly take her out of office. >> we're calling upon the board to reject this illegal effort, this ill-funded effort, this misguided effort. >> reporter: current d.a. price questioned the legality of the recall campaign from fundraising to signature gathering and even how the county registrar managed the process. >> the registrar is trying to

conduct an illegal election. i don't know what his motivation is. >> reporter: as far as the motive for the recall, she says it's because she's the first black woman to hold the office. >> this is not about public safety. it doesn't appear to have a basis other than of racism. >> what color am i? i'm african american. my name is first on the recall petition. line number one, my name, brenda faye grisham. >> reporter: grash grisham is one of the founders of the organization that organized the recall effort. >> we're not going to wait eight months for a recall opportunity. we are not going to do it. >> reporter: a special election in august would cost anywhere from $15 million to $20 million. the other option is to put the recall on the november ballot during the general election. >> i don't care about the

money. i care about the justice, and i care about other people behind me getting their justice too. >> all right, here's what comes next. the board of supervisors says it will meet again on may 14th to decide whether to hold a special election or add the recall to the november ballot. if the recall is successful, the board of supervisors would have to appoint a new d.a. to serve until the next 2026 election. so you might remember this video of mike tyson punching a man on an sfo flight. oh. well, now he's facing a lawsuit that was filed right under the wire. and how a school history presentation ended in a campuswide lockdown. vern? >> hey, later on in sports, a bay area baseball team is inching up to an even one loss record, and they don't wear orange and black. and i'll show you what was the buzz in the desert. nice weather across the bay area for this last day of april, including a beautiful

tyson. we showed you the video of the boxing legend punching a first class passenger on an sfo flight. >> hey, hey, hey, hey. hey, mike, come on. >> oh. that was in 2022. mike tyson had this scuffle with another passenger on a jetblue flight. just one day before the two-year statute of limitations ran out, the man beaten in this video filed suit. >> talking to mike tyson, bro. this is crazy, bro, mike tyson. he don't know how to act. tyson looking out, man. >> so that passenger, melvin townsend, claims he was just trying to talk to tyson on the flight before the brawl. he is now suing tyson for battery and emotional distress. a novato high school presentation went sideways when a guest speaker brought in a real grenade and that prompted a schoolwide shelter in place. but police realized the grenade

was just a prop the speaker was using to talk about his war experience and was not active. the shelter in place was lifted and deemed no threat to students or the community. starting tomorrow, commuters can take the ferry again between sausalito and san francisco. golden gate ferry service was suspended on the 19th after some damage was spotted on one of the four piles of the sausalito pier, but repairs are done and the pier was declaired safe. we have our weather achanging very quickly, enjoy it while it lasts, right, paul? >> yeah, temperatures are warming up next month. today the last day of april, may is just about 45 minutes away, and we are going to be into a warmer than normal weather pattern with dry conditions continuing through the rest of the workweek. it is going to be a little breezy at times as this storm system diving through the pacific northwest is close enough to help squeeze the atmosphere over california and produce those gusty offshore winds away from the

coast. but the winds are still going to be onshore along the coast so the wind's converging over to bay area. let's track those winds. a wind advisory for solano county until 5:00 tomorrow. went into effect at 11:00. the strongest winds occur about mid-morning tomorrow. some 25-mile-an-hour gusts around fairfield . by tomorrow afternoon things already backing down. temperatures are going to be warming up, though, as we head into the first afternoon of may. the flag is just kind of hanging there, you can barely see it. temperatures have dipped into the 50s. we're not done dropping. anywhere from 52 in livermore to 59 in concord. mostly in the 40s by tomorrow morning, which isn't that cool for the first morning of may. just one to three degrees below average. the very mildest spots staying in the low 50s. and temperatures are going to warm up quickly. we are going to make it up to around 80 degrees for inland temperature a mix of upper 70s and low 80s but about six or seven degrees above

normal for everybody. low 80s more likely inland in the east bay, should make it into the and mid-70s around fremont and redwood city. where you won't be six or seven degrees above average, half moon bay, but 62 degrees, it's at least three degrees above normal. take what we can get. temperatures in the upper 60s, close to 70 in the city. mid-70s for oakland and a mix of mid to upper 70s and low 80s inland in the north bay right at 80 degrees in napa and 80 degrees in santa rosa. farther down the line, we're tracking some big changes in the forecast. let's take a look at our side-by-side forecast models and track the rain chances for this upcoming weekend, the first weekend of may, cinco de mayo weekend. it's going to feel like saint patrick's day weekend, because it's much cooler and looking increasingly wet. the two long-range forecast models we're still out of range of the higher resolution forecast data. we'll get that in tomorrow. but both the long range models paint a good chance of rain moving into the bay area on saturday. so they agree on that now. they were not agreeing on that 24 hours

ago. they still have some differences. how much rain are we going to get? how long is it going to last? the american forecast model is wetter, keeping that chance of lingering showers in the forecast into the second half of the weekend. we'll keep an eye on those trends for you. right now i wouldn't cancel anything on sunday but i would be flexible with outdoor plans. and saturday, i would start looking for an indoor alternative to any outdoor plans. amounts are going to be modest. 0.1 of an inch to 0.25 of an inch for most of the bay area. the higher amounts closer to 0.5 an inch of rain. likely less than 0.1 of an inch in the east bay around antioch. we'll keep you updated as the weekend gets closer. let's take a look at the seven-day forecast, and while we are tracking the chillier and wetter conditions for weekend, nice weather in store the next few days. high temperatures around # 0 degrees inland. a mix of upper 70s and low 80s. it's going to be a good 10 to 15-degree drop across the bay area from friday to saturday. some places even more than that. it's just going to be kind of raw on

saturday. by next week we're going to be drying out again, but temperatures are running just a little bit below average by monday and tuesday for the beginning of the first full week of may. but again, the rain should be in the rearview mirror by that point and right now it does look like maybe this would be the last significant rain chance that we see during the season as we get a little bit farther into may. those rain chances tend to be even fewer and farther between, jules? >> all right, may around the corner. very close. some couples, you know, they get married underwater or on top of mountains, but what about a music festival? now people can tie the knot this year at outside lands. straight ahead in sports, four quarters of basketball, not enough in this nba playoff game. and don't overlook the a's. you just might get run over. - [narrator] at kpix, we're taking weather to the next level. - we can show not just what's happening at ground level,

climb and hang upside down. he's even adjusted sedated lions. like this one in south africa. skeptics say chiropractic has no basis in science, that there's no proof it works on humans or animals, but jerry's owner told "the washington post" the giraffe's chewing improved after his adjustment. >> oh, there we go. >> reporter: and look at that reaction. one commenter called it the look of bliss. >> they're lot more appreciative, i think, than some of my human patients. he absolutely loved it. i mean, he was rubbing all over me. he was licking all over me. >> reporter: we do not recommend this much necking when showing appreciation to your chiropractor. so we're used to seeing sea lions lounging around fisherman's wharf and hearing their barks, but this is on a whole other level. they're being drawn to the wharf like magnet, so what is causing this

people you see there enjoying the view. >> they're so amazing. they're very beautiful. massive. they're so huge. very, very cool to watch. >> pretty cool. i've never seen sea lions in one place before. looks like a bunch of kids vying for a good spot on the couch. >> on the couch. the last time the sea lion count was this high was in 2009 when the docks had a record high 1,700 sea lions. >> 1,700. >> oh, look at them lounging in the sun. >> how does word get around? >> you know, that is so true. >> in the sea lion community. >> yeah. the bark has some sort of communication then, huh? >> i bet that smells heavenly. >> you said you walked down there. >> i walked by on my break, but i didn't get close enough to catch a whiff. the funk of sea lion. >> kind of brought it into the - lift the clouds off of... - virtual weather, only on kpix and pix+.
